Terms of Service — Platos Verdes

1.Acceptance of these Terms

By using the Service, creating an account, or checking the acceptance box, you confirm that you have read and agree to these Terms and our Privacy Notice. If you do not agree, please do not use the Service.

2.Who may use the Service

You must be at least 18 years old to create an account or submit content. By using the Service, you represent that you are 18 or older. We do not knowingly collect data from children under 13.

3.Your account

Accounts are free and optional: you can read recipes and articles and take the quiz without one. With an account you can save recipes, keep your profile and quiz result, and track your progress in “Mi Transición.”

• Provide accurate information and keep it current.
• You are responsible for your account’s security and for activity under it; tell us if you notice unauthorized use.
• We may suspend or terminate an account that breaches these Terms or is used abusively or fraudulently (see §13).
• You may close your account and delete your data at any time using the privacy tools; deletion is immediate and cannot be undone.

4.Acceptable use

You agree not to:

• copy, scrape, bulk-download, or index the content by automated means, or circumvent the Service’s technical limits (including request rate limits);
• republish, resell, or make commercial use of our content (see §5);
• submit content that is abusive, unlawful, deceptive, or that infringes others’ rights;
• interfere with the security or operation of the Service, or attempt to access others’ accounts or data;
• describe foods or recipes as a treatment or cure for a health condition (see §6).

5.Our content and intellectual property

The content of the Service — recipes, text, photographs, videos, design, and trademarks — is owned by Platos Verdes or used under license, and is protected by law. We grant you a personal, limited, non-exclusive, non-transferable license to access and use the content for personal, non-commercial purposes.

You may link to our pages and share them using the site’s social-share buttons. You may not republish, substantially reproduce, sell, or incorporate our content (for example, recipes or photographs) into another site or product. Ingredient lists themselves are not protected by copyright; the written expression, photographs, and design are.

6.Health and nutrition content — educational, not medical advice

Platos Verdes is educational content about cooking and eating with more plants. It is not individualized medical or nutritional advice, a diagnosis, or a treatment, and it does not replace care from a health professional. Using the Service does not create any provider-patient or professional-client relationship between you and Platos Verdes. Talk with your doctor or a health professional before making changes to your diet, especially if you live with a health condition or take medication.

The full notice that applies to all health content is the site’s canonical medical disclaimer (the “Educational content; not a substitute for medical advice” notice shown on every health surface). That notice is incorporated into these Terms by reference; it is not reproduced here, to avoid divergence between documents.

7.Content you submit (“Send your dish”)

If you send us a dish, your story, or other material, that submission is governed by the Permission to adapt your dish (a separate document). That document describes the license you grant us, your optional credit, and how to ask us to remove your content. In v1, nothing you submit is published automatically: submissions go to a private queue only our team sees.

8.Paid digital products

Platos Verdes may offer paid digital products. Any purchase is governed by the Terms of Sale (a separate document), which cover price, delivery, refunds, and payment via Stripe. If these Terms conflict with the Terms of Sale as to a purchase, the Terms of Sale control for that purchase. In v1 there are no subscriptions or recurring charges.

9.Newsletter and email

The newsletter is optional and has its own consent; you can unsubscribe at any time. Email handling and privacy are governed by the Privacy Notice and the related consent copy.

10.Third-party links and services

The Service may link to third-party sites or services we do not control. We do not endorse and are not responsible for their content, products, or privacy practices. Any affiliate or sponsorship disclosures will appear clearly and conspicuously where applicable.

11.Disclaimer of warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW. Nutrition information is estimated (USDA-sourced) and is not exact or guaranteed; verify ingredients yourself if you have allergies or restrictions. You prepare and eat recipes at your own risk.

12.Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PLATOS VERDES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF WHAT YOU PAID IN THE PRIOR 12 MONTHS OR US$100. Nothing in these Terms limits liabilities that cannot be excluded by law.

13.Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service abusively or fraudulently — immediately in serious cases and, where reasonable, with prior notice. On termination, sections that by their nature should survive (§§5, 6, 11, 12, 14, 17) remain in effect.

14.Dispute resolution — governing law and venue

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. This does not deprive you of the mandatory consumer protections of where you live. Disputes will be resolved exclusively in the state or federal courts located in Sarasota County, Florida, and you consent to their jurisdiction. These Terms contain no mandatory arbitration and no class-action or jury-trial waiver.

15.Copyright complaints

If you believe content on the Service infringes your copyright, contact us at info@platosverdes.com with enough detail to identify the work and the allegedly infringing material, and we will review and respond in accordance with applicable law.

16.Changes to these Terms

We may update these Terms. We will post the current version with its “last updated” date; for material changes, we will notify registered accounts by a reasonable means. Continued use of the Service after a change means you accept the new Terms.

17.General

We may assign these Terms (for example, in a sale of assets); you may not assign them without our consent. If any provision is held invalid, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the documents they incorporate by reference, are the entire agreement between you and us regarding the Service.

Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control (for example, natural disasters, internet, power, or provider outages, labor disputes, or acts of government).

Notices. Notices we must give you will be sent by email to the address associated with your account or by a conspicuous posting on the Service; notices you wish to give us must be sent to info@platosverdes.com.

19.Languages

These Terms are published in Spanish and English with equal prominence and identical intent. If there is any conflict between the two versions, the English version controls.
